Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Secblok Pty Ltd (ABN 60 600 732 474) ("Secblok", "we", "us", "our") governing your access to and use of the Pixestate platform, including the web application at pixestate.ai and the desktop application (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account Registration

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorised use of your account.

4. Credits and Payment

Pixestate operates on a credit-based system. You purchase credit packs and spend credits on AI processing operations.

• No subscription: Credits are purchased as one-time transactions. There are no recurring charges.
• No expiry: Purchased credits do not expire and remain in your account until used.
• Non-refundable: Credit purchases are non-refundable once processed, except where required by the Australian Consumer Law. If you believe a consumer guarantee has not been met, please contact us.
• Credit costs: Each AI operation (staging, sky replacement, photo fix, cleaning, renovation) costs credits as displayed on our pricing page. Scene analysis and export are free. We reserve the right to adjust credit costs with reasonable notice.
• Payment processing: Payments are processed by Stripe. By purchasing credits, you also agree to Stripe's terms of service.

5. Australian Consumer Law Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and obtain a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law.

6. Acceptable Use

You agree to use the Service only for lawful purposes related to real estate photography and property marketing. You must not:

• Upload content that is illegal, harmful, defamatory, obscene, or infringes the rights of others
• Use the Service to create misleading or deceptive property representations that violate real estate advertising laws
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms used by the Service
• Use automated scripts or bots to access the Service without our written permission
• Share your account credentials with third parties or allow unauthorised access to your account
• Resell, sublicense, or redistribute the Service without our written consent

7. Intellectual Property

Your content: You retain ownership of all photos you upload to the Service. By uploading photos, you grant us a limited licence to process, transform, and store them solely for the purpose of providing the Service to you.

AI-generated outputs: You own the edited photos and videos generated by the Service from your uploaded content. You may use them for any lawful purpose, including commercial property listings.

Our platform: The Pixestate platform, including its software, AI models, design, branding, and documentation, is owned by Secblok Pty Ltd and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.

8. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control. We will endeavour to provide reasonable notice of planned downtime where practicable.

9. Limitation of Liability

To the maximum extent permitted by law and subject to Section 5 (Australian Consumer Law Guarantees):

• The Service is provided "as is" and "as available" without warranties of any kind beyond those required by law.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total liability for any claim arising from or related to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for the accuracy or suitability of AI-generated edits for your specific listing requirements. You are responsible for reviewing all edits before use.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service if you breach these Terms, with or without notice depending on the severity of the breach.

Upon termination, your right to use the Service ceases immediately. Any unused credits in your account at the time of termination due to your breach are forfeited. If we terminate your account without cause, we will refund the value of unused credits.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service are subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
